Terms of Service

Terms for using Insite.

1. Agreement to These Terms

These Terms of Service govern your access to and use of Insite, a creative intelligence platform for marketing teams. By creating an account, connecting a platform, uploading content, or using the service, you agree to these Terms on behalf of yourself and, if applicable, the company or organization you represent.

If you do not agree to these Terms, do not use Insite.

2. What Insite Does

Insite helps marketing teams organize, search, and analyze creative work across channels such as YouTube, Instagram, ads, websites, CRM systems, and payment providers. The service may process videos, captions, transcripts, on-screen text, engagement metrics, traffic data, signup data, revenue data, and related metadata to help explain what creative assets and campaigns appear to be driving business outcomes.

Insite provides analytics and decision-support outputs. It does not guarantee marketing performance, revenue results, attribution accuracy, platform availability, or any specific business outcome.

3. Accounts and Workspaces

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account or workspace. You must provide accurate information, keep your account details current, and promptly notify us if you believe your account has been compromised.

You may invite team members only if you have authority to grant them access to the workspace and the data inside it.

4. Customer Content and Data

"Customer Content" means content, files, videos, transcripts, metadata, analytics, platform data, business outcome data, and other information that you submit, upload, connect, or authorize Insite to access.

You retain ownership of your Customer Content. You grant Insite a limited license to host, store, process, analyze, transform, display, and transmit Customer Content as needed to provide and improve the service, including generating structured metadata, searchable records, insights, comparisons, and reports.

You represent that you have the rights, permissions, and authority needed to provide Customer Content to Insite and to allow Insite to process it under these Terms.

5. Connected Platforms and Third-Party Services

Insite may allow you to connect third-party services such as YouTube, Instagram, ad platforms, website analytics tools, CRM systems, and payment providers. By connecting a third-party service, you authorize Insite to access and process the data made available through that connection.

Your use of each third-party service remains subject to that service's own terms, policies, permissions, API limits, review requirements, and data use rules. Insite is not responsible for third-party service outages, API changes, revoked permissions, delayed data, incomplete data, or provider decisions to restrict access.

6. AI, Analytics, and Attribution Outputs

Insite may use automated systems, statistical methods, and AI-assisted analysis to extract transcripts, hooks, topics, CTAs, visual patterns, editing styles, product mentions, and performance explanations from Customer Content.

Outputs may be incomplete, inaccurate, or based on correlations rather than causation. You are responsible for reviewing outputs before relying on them for business, advertising, financial, or operational decisions.

7. Acceptable Use

You may not use Insite to violate laws, infringe intellectual property rights, misuse platform APIs, scrape data without authorization, upload malicious code, interfere with the service, attempt to bypass access controls, reverse engineer non-public parts of the service, or process data you do not have permission to use.

You may not use Insite to create, manage, or optimize campaigns that are unlawful, deceptive, discriminatory, or otherwise prohibited by applicable advertising rules or connected platform policies.

8. Security and Privacy

We use reasonable technical and organizational measures designed to protect Customer Content. No system is perfectly secure, and we cannot guarantee that unauthorized access, loss, or misuse will never occur.

You are responsible for configuring connected accounts, team access, permissions, and data exports appropriately for your organization.

9. Fees and Plans

Some features may require a paid subscription, usage-based fees, or a separate agreement. If paid plans are introduced or changed, the applicable pricing, billing terms, renewal terms, and cancellation terms will be presented separately.

10. Beta Features

Insite may offer early, experimental, or beta features. Beta features may change, break, produce inaccurate results, or be discontinued at any time. Beta features are provided as-is and should not be treated as production-critical unless we agree otherwise in writing.

11. Service Changes and Availability

We may modify, suspend, or discontinue parts of the service at any time. We may also update integrations when third-party APIs change. We are not liable for downtime, data delays, API changes, or loss of access caused by third-party services.

12. Termination

You may stop using Insite at any time. We may suspend or terminate access if you violate these Terms, create security risk, misuse connected platforms, fail to pay applicable fees, or use the service in a way that may harm Insite, other users, or third parties.

13. Disclaimers

Insite is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.

14. Limitation of Liability

To the fullest extent permitted by law, Insite will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or reputational harm arising from or related to your use of the service.

15. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice through the service or another appropriate channel. Continued use of Insite after changes become effective means you accept the updated Terms.
